MARTIN COUNTY — A Circuit Court judge Thursday denied Lake Point developers’ claims that Martin County broke state public-records law.
Lake Point has made several allegations against the county, including that it altered, destroyed and delayed the production of public records. The records include emails and County Commissioner Sarah Heard’s notes.
Judge F. Shields McManus said the county “did not unlawfully refuse to permit” some the emails to be inspected and copied.
The county’s delay in discovering other emails was “inadvertent,” the judge ruled.
The judge’s decision solves one part of a larger litigation.
Lake Point sued the county over breach of an interlocal agreement that would allow Lake Point to mine rock on an about 2,000-acre property in western Martin County.
Under its agreement with the Water Management District, Lake Point was to turn over its land to the district in exchange for the right to mine there.
Lake Point also has sued the South Florida Water Management District and former County Commissioner Maggy Hurchalla.
